By downloading, installing, or using Eddy ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software. If you are using Eddy on behalf of a school or organization, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
Eddy is an AI-powered desktop learning platform that provides tutoring, course management, gamified learning, and educational tools for students, teachers, parents, and administrators. The Software runs locally on Windows computers and processes educational interactions using AI technology.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must not share your account with others or allow unauthorized access.
- Accounts for children under 13 must be created by a parent, guardian, or authorized teacher.
4. Free and Paid Plans
- Free Plan: Includes 5 AI chat interactions per day, 1 student profile, and basic features. Free forever with no payment required.
- Paid Plans: Subscription plans (Teacher, Homeschool, School) provide additional features and are billed monthly through Stripe. You may cancel at any time.
- Refunds: We offer a 14-day money-back guarantee on all paid plans. Contact us within 14 days of your initial subscription for a full refund.
5. Acceptable Use
You agree not to:
- Use Eddy for any unlawful purpose
- Attempt to bypass content safety filters or moderation systems
- Reverse-engineer, decompile, or disassemble the Software
- Share, redistribute, or sublicense the Software without authorization
- Use the Software to generate harmful, inappropriate, or non-educational content
- Misrepresent your identity or role within the platform
6. AI-Generated Content
Eddy uses artificial intelligence to provide tutoring and educational assistance. While we implement content moderation and safety filters:
- AI responses are educational aids, not professional advice
- AI-generated content should be verified by teachers or parents for accuracy
- We continuously improve our content filters but cannot guarantee perfection
- Users should report any inappropriate AI responses immediately
7. Intellectual Property
The Software, including its code, design, and branding, is owned by Charging Bull Software. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Software. Content you create within Eddy (courses, assignments, notes) remains your property.
8. Privacy
Your use of Eddy is also governed by our Privacy Policy and COPPA Compliance documentation. By using Eddy, you consent to the data practices described in those policies.
9. Limitation of Liability
To the maximum extent permitted by law, Charging Bull Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software. Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to Eddy if you violate these Terms. You may terminate your account at any time by contacting us. Upon termination, your license to use the Software ends, but your locally stored data remains on your device.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or in-app notification at least 30 days before changes take effect. Continued use after changes constitutes acceptance.
